Importance of Mehr

Mehr is the right of the wife and Shariah has accepted this right. In case of Mehr not defined or stipulated, Mehr e Misal will be  paid. In Quran Allah says:

 

 

 

{وَآتُوا النِّسَاءَ صَدُقَاتِهِنَّ نِحْلَةً} [النساء: 4]

 

[And give the women (on marriage) their Mahr as a free gift]

 

 

 

Mehr e Misal

 

Mehr e Misal is determined by comparing with women who belong to the family of the bride’s father and these women should be similar or equal to the bride in terms of youth, beauty, virginity, wealth, education, religion and intelligence

 

Mehr e Musamma

 

Mehr which is determined by a groom  is called Mehr e Musamma.

 

According to Sharia, Mehr could be paid completely or partially at the time of marriage and postponed with mutual understanding.

 

Mehr can be in the form of cash or goods or both. If the wife withdraws her right of Mehr, the husband can utilize it as mentioned in following verse of Quran:

 

 

 

{فَإِنْ طِبْنَ لَكُمْ عَنْ شَيْءٍ مِنْهُ نَفْسًا فَكُلُوهُ هَنِيئًا مَرِيئًا} [النساء: 4]

 

[But if they of their own good pleasure remit any part of it to you take it and enjoy it with right good cheer.]

 

 

 

Minimum amount of Mehr must be equal to 10 Dirhams which is equal to 30.830  gm silver while there is no limitation of maximum amount, however Shariah prefers to be determined it according to the financial position of the groom.
